Novicate Academy Pty Ltd., ACN 657118 299, ABN 63 657 118 299 (subsequently referred to as"Novicate Academy", or “the Company”) is the owner of novicate.com(subsequently referred to as “the “Website”). By using this Website, you indicate that you have read and understand these Terms and Conditions and agree to abide by them at all times.
All content published and made available on our Site is the property of Novicate Academy and the Site's creators. This includes, but is not limited to images,text, logos, documents, downloadable files and anything that contributes to the composition of our Site.
As a user of our Site, you agree to use our Site legally, not to use our Site for illegal purposes, and not to:
· Violate the intellectual property rights of the Site owners or any third party to the Site;
· Act in any way that could be considered fraudulent; or
· Harassing tutors in any means.
If we believe you are using our Site illegally or in a manner that violates these Terms and Conditions, we reserve the right to limit, suspend or terminate your access to our Site. We also reserve the right to take any legal steps necessary to prevent you from accessing our Site.

These Terms and Conditions apply to all the goods and services that are displayed on our Site at the time you access it. This includes all products listed as being out of stock. All information, descriptions, or images that we provide about our goods and services are as accurate as possible.
However, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods and services we provide. You agree to purchase goods and services from our Site at your own risk.
We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment,we will give you a refund equal to the amount you paid. You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.
Your subscription automatically renews and you will be automatically billed until we receive notification that you want to cancel the subscription.
We offer the following free trial of our goods and services: Novicate Academy offers students a 7- day free trial for all silver program subscriptions. Novicate Academy may offer students free trials for 1-on-1 and Gold Program tutoring during various promotions. Silver Program free trial includes unlimited non-download access to all resources, including booklets, tests and recordings. Please note that once signing up for the paid program you will be able to download all content, question resources and topic tests.
To cancel your free trial, please follow these steps: If you wish to cancel your subscription, or one- time purchase, you must notify Novicate Academy before your 7 day free trial time lapses.
At the end of your free trial, the following will occur: Upon signing up for a 7-day free trial for any service or product (silverprogram) you will be required to input your details on our Novicate Stripe Checkout page. If you do not cancel your subscription before your 7-day trial period ends, you agree to be automatically charged the specified amount included in the Stripe Checkout page upon signing up.
We accept the following payment methods on our Site:
· Credit Card;and
· Debit.
When you provide us with your payment information, you authorise our use of and access to the payment instrument you have chosen to use. By providing us with your payment information, you authorise us to charge the amount due to this payment instrument.
If we believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.
Once a lesson (either through in-person or online means) has been arranged, Novicate Academy, acting on behalf of the tutor, considers this booking to be final, subject to this cancellation policy.The booking student, or parent on behalf of the student, agrees that once they make payment there will be no return of payment if the cancellation is beyond 24 hours before the scheduled class.
If the cancellation occurs before this time, payment will be returned as credit for use for Novicate Academy services and products. Note that if a lesson is cancelled for any reason, the student must notify the tutor immediately outlining reasons for cancellation.
Acceptable reasons for cancellation
The student will be provided a corresponding credit to Novicate Academy services and products in the instance that the lesson is appropriately cancelled more than 24 hours before commencement due to any of the reasons:
· The tutor cancelling the lesson for any reason, or failing to be at the agreed place (physical or virtual) at the agreed time for any reason;
· The student being sick (as certified by a medical practitioner);
· The student having an appointment which is both important and urgent, and unable to be rescheduled;
· The student and the tutor agreeing to cancel the lesson;
· The student cancelling the lesson with sufficient notice, more than 24 hours prior to the commencement time of the lesson;
· Any other unforeseeable event which should reasonably take precedence over the student’s attendance at the lesson.
Unacceptable reasons for cancellation
The student will not be provided a corresponding credit to Novicate Academy services and products in the instance that the lesson is appropriately cancelled more than 24 hours before commencement due to any of the reasons:
· The student’s lateness, including but not limited to lateness due to transport delays;
· A reasonably foreseeable or regular event which would otherwise satisfy any of the acceptable reasons for cancellation above, with the exception of a court appearance;
· Any event which is unable to be rescheduled due to a lack of planning by the student;
· Other work or study commitments;
· Any unexplained failure to be at the agreed place (physical or virtual) at the agreed time.
All servicessold on our Site are non-refundable. However the cancellation policy applies to products and services outlined in our cancellation policy.
While Novicate Academy provides professional and knowledgeable tutors to students, we do not guarantee specific student results. The result of a student is dependent on many factors,including their study habits, work ethic, schooling experience, teaching methods and engagement at school.
While Novicate Academy is dedicated to providing the best tutoring by hiring only the best tutors possible to help support and guide the student, our tutors should not be viewed as a replacement for laziness, nor the providers of a guaranteed result. Novicate Academy hereby highlights that the Company will not be legally responsible should results not be deemed desirable by a Client.
On the Novicate Academy website, the term ‘screened’ refers to tutors sending through a mock tutoring video for usto review prior to being onboarded. We review these videos to ensure passion and ability to teach. The term ‘qualified’ refers to a past Year 12 graduate who has attained the study score for their respective subject. ‘Qualified’ should not be confused with having earned a teaching degree unless otherwise stated by the tutor in their profile.
We acknowledge that material appearing on Novicate Academy website, as well as material in the booklets and products provided or sold to students, may include technical,typographical or photographic errors. Novicate Academy does not affirm that any of the materials on its web site are accurate,complete, or current. The Company may make changes to the materials contained on its website at any time without notice. Novicate Academy also acknowledges that several diagrams in tutoring booklets have been sourced from online mediums. Where these diagrams were not produced directly by Novicate Academy we ensured to acknowledge the source of the diagram. To our best interest these diagrams are not copyrighted. Any diagrams not containing a source reference were produced authentically by Novicate Academy.
You shall not use the Website to inquire about, engage in or aid or assist anyone with any action that would be a breach of academic honesty. For example, completing assignments or projects,writing papers or essays, taking (or help take) quizzes or examinations on someone’s behalf, or completing work in violation of academic policies or other conduct policies of a school, university, academic institution or workplace.
Our Site contains links to third party websites or services that we do not own or control.We are by no means responsible for the content, policies, or practices of any third party website or service linked to on our Site. It is your own responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites and therefore, use of any linked website is at the user’s own risk.
Novicate Academy Pty Ltd. and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages for loss of data or profit, liabilities and expenses arising out of use or inability to use the Website. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
Except where prohibited bylaw, by using this Site you indemnify and hold harmless Novicate Academy Pty Ltd. and our directors,officers, agents, employees, subsidiaries, and affiliates from any actions, claims,losses, damages, liabilities and expenses including legal fees arising out of your use of our Site or your violation of these Terms and Conditions.
